PLATINUM SKY MAINTENANCE (PSM) TERMS AND CONDITIONS

THE TERMS AND CONDITIONS OF PLATINUM SKY MAINTENANCE (“THE PLATINUM SKY MAINTENANCE”), ALONG WITH PLATINUM SKY MAINTENANCE PRIVACY AND OUR TERMS OF SALE OUTLINED IN THIS PROPOSAL (“THE PROPOSAL”), ARE THE ONLY TERMS APPLICABLE TO ALL OF OUR SERVICES, INCLUDING CONSULTATION SERVICES, AOG SERVICES, PARTS REPAIR, AVIATION MAINTENANCE, MANAGEMENT, AND THE OVERHAUL OF YOUR AIRCRAFT OR EQUIPMENT AS DESCRIBED IN THESE TERMS. 

All services provided by Platinum Sky Maintenance (PSM), including but not limited to maintenance, repair, and consultation services, are performed and contracted directly between an authorized PSM employee or affiliate that is certified and licensed to deliver such services.

AIRCRAFT CONDITIONS AND PRICING

Prices for inspections, installations, maintenance, and all other services are based on this proposal’s current date and circulation. Subsequent releases may cause prices to change when provided with required data. Pricing is based on the aircraft’s conditions, the amount of space for the requested work, and electrical interfaces. Prices are contingent on PSM customers providing us with all maintenance data, records, and documents that represent the current condition of the aircraft, including weight, electrical load analysis, existing avionics, diagrams, and any other data. Discrepancies in data or documentation provided to Platinum Sky Maintenance that result in Platinum Sky Maintenance having to do further research may cause additional charges and extend downtime. PSM pricing assumes that the aircraft’s current configuration matches the existing wiring prints and structures provided to PSM, which will NOT have to be modified or tested to complete the work. If one or more of these assumptions are wrong, the customer will be provided with an estimate of the additional costs required to correct the deficiency. All customers and clients of Platinum Sky Maintenance are responsible for the costs of repairs, transportation costs, or replacements performed by or at Platinum Sky Maintenance. Fuel, engine runs, flight costs, freight charges, and crew expenses are also the customer’s responsibility. Unless otherwise and specifically stated, all furnishings and equipment that are removed shall become the property of Platinum Sky Maintenance. The cancellation of agreed-upon work is subject to penalty charges. 

EQUIPMENT SUBSTITUTIONS 

When deemed necessary to improve aviation equipment’s performance, stability, utility, or quality, Platinum Sky Maintenance may substitute accessories, parts, materials, or equivalent equipment to incorporate changes in the installation, design, and construction of goods or materials. Platinum Sky Maintenance herein reserves the right to substitute similar materials. 

CUSTOMER-SUPPLIED PARTS

Customer-supplied parts go through an inspection process. Before customer-supplied parts are approved, the customer shall provide all appropriate documentation required by the governing authority. Handling charges of the aircraft’s list price will be invoiced to the customer. Fees range on a percentage basis. 

ADDITIONAL WORK

All additional work requests will extend the original downtime of work components and ultimately increase the final invoice. 

PAINT 

All paint renderings of an aircraft may require additional stripping or chemical removal. All painting designs will be adhered to in the original scheme, and the customer will be notified if alternations are needed to be made. Platinum Sky Maintenance is not responsible for the lifting, peeling, discoloring, or damages resulting from environmental factors (acid rain, static popping, or severe heat) of paint on any aircraft.

DELAYS

All completion dates are estimated and not guaranteed. Platinum Sky Maintenance is NOT responsible for damages or loss of use that is consequential with parts availability, materials from suppliers, transportation delays, labor strikes, or any other causes beyond Platinum Sky Maintenance’s control. 

BILLING 

Suppose Platinum Sky Maintenance cannot secure final pricing for specific parts or services at the time of invoice. In that case, PSM will process the payment on an estimated invoice, and once the final prices are known, an additional invoice will be provided to the customer. 

PAYMENT 

Unless contractually agreed upon, payment for services and parts provided by Platinum Sky Maintenance is due upon the completion of work and before the aircraft is released to the customer. Any form of payment the customer uses is the customer’s and the customer’s responsibility alone. Projects with an excess of $500,000 require progress payments. Progress payments are due on a percentage basis:

1. 25% is due at the time the proposal is accepted 

2. 25% is due upon inputting the aircraft into the maintenance facility

3. 25% is due when the aircraft is at 50% completion

4. The remaining balance is due via wire transfer before releasing the aircraft. 

All rates provided by Platinum Sky Maintenance are standard rates that do not include overtime. Overtime rates will be billed to the customer as needed. Once deposits are 90 days from the aircraft arrival date, they will become non-refundable. If the project is canceled within this time, it will be retained by Platinum Sky Maintenance as liquidation damages. 

SALES TAXES 

Sales taxes are not included in our company prices and charges. All Platinum Sky Maintenance customers are responsible for sales taxes, tariffs, fees, and duties imposed by governmental authorities. If the customer seeks tax exemptions of any kind, they shall show proof of acceptable affidavits or exemptions. 

INSPECTIONS 

Upon receiving their aircraft after our services have been completed, customers shall inspect their aircraft thoroughly. Claims and returns of any kind regarding the aircraft shall be produced in writing within ten days of unacceptable or incomplete work. In agreement with these Terms and Conditions, failure to provide a written claim shall constitute an irrevocable acceptance on behalf of Platinum Sky Maintenance. 

WARRANTY PROGRAMS 

Platinum Sky Maintenance is NOT responsible for manufacturer warranties, nor are we (PSM) responsible for canceled or denied warranty programs. 

RESPONSIBILITIES

Platinum Sky Maintenance customers agree that Platinum Sky Maintenance is NOT responsible for pilots who operate an aircraft that PSM has serviced. PSM customers are herein accountable for costs, damages, judgments, suits, demands, and claims arising from any aircraft’s in-flight operation. In place of these Terms and Conditions, customers acknowledge that they are responsible for ensuring their aircraft is insured and for damages to the aircraft regardless of which party causes the damages. 

LIABILITY

PLATINUM SKY MAINTENANCE IS NOT LIABLE FOR ANY LOSS, VALUE DEPRECIATION, OR INCIDENTAL OR CONSEQUENTIAL DAMAGES TO THE AIRCRAFT. THESE PSM TERMS AND CONDITIONS (THE ‘TERMS AND CONDITIONS’) OF PLATINUM SKY MAINTENANCE ARE IN CONJUNCTION WITH OUR PRIVACY POLICY AND HEREOF SUPERSEDE PRIOR CONTEMPORANEOUS WARRANTIES OR AGREEMENTS. IF NOT STATED IN THESE TERMS, THE SAME INFORMATION IN OUR PRIVACY POLICY APPLIES.
